Q: What are my rights when loan company accidentally pays off car loan?
My husband and I had our trucked financed through Citifinancial. We came into some financial hardships and just needed to defer our payments for a month till we got back on good footing. A month later, we receive a letter with our original finance papers stamped with "PAID IN FULL" across them. We were puzzled. My husband immediately called them and asked about this and we were told by one of the agents who said that we had a zero balance and that everything is in order. Strange, bizarre, but we figured that because of the financial state of the country, we figured that lenders were writing off debts on loans that were previously set on high interest rates or something... Fast forward 6 months later, we receive several phone calls from what the caller ID shows as "Irving, TX" and an agent left a message on our machine stating that they wanted to talk to my husband about reopening our loan...We call them back and we are told that our car loan was accidentally paid off and Citifinancial wanted to reopen our loan due to this mistake, but in order to get the ball rolling, they needed our original loan papers with "PAID IN FULL" back. A few days later, we receive a UPS correspondence from these same people claiming they are Citifinancial, but it just all seems too suspicious. NO official letter head, first names only on the documents, etc. They are even asking for the money retroactive to the mistake, so we are talking about 6 months worth of payments paid back to them for their error. What are our legal rights? If they send us paper work stating that our loan is paid off, are we obligated to reopen this loan or even pay any money back retroactively? Anyone else ever experience this?

A: Auto finance is what I do for a living do not send them anything. Don't even talk to them. If they call simply say I don't know what your talking about I have your letter stating that our account is paid in full and hang up. Your best defense is their letter stating that your account is paid in full. You are not legally obligated to to reopen this loan in any way, their mistake is your windfall.

Q: Should I really change the timing belt at 35K miles?
I drive a 2002 Hyundai Elantra, with 35,000 miles on it. The dealer in Sunnyvale recently recommended that I get my timing belt and AC belt replaced. I took the car to a local guy, Habelt's on Irving Street in San Francisco, and that guy told me not to replace it just yet. He said 60,000 miles is the standard, regardless of chronological age. Should I go ahead and get it done (for $600 or so) or should I wait until the mileage gets closer to 60K?

A: What is the manufacturers recommendation (check your owners manual)? Lots of less than reputable dealers and Jiffy lube type shops try to con drivers into having this done early because of the profit they make. I think you will find you do not need to do this for quite a while.

Q: Can I picket on the highway in Irving, TX?
Hi. A Hyundai dealership in Irving, TX is screwing over my mother. Her steering wheel is deteriorating on a car only four years old. The dealership says it's not covered on her warranty as the steering wheel is only trim. Trim being just decoration not necessary to the cars function. LOL The steering wheel is just decoration!!!! Can I picket them? They are on a frontage road next to a highway. There is no sidewalk in front and next to them is more dealerships. I was planning to stand on the grass between the frontage road and the highway and hold up my signs there. Is this legal? Do I need a permit? Can they have me arrested? Any info would be great. Thanks. :) This isn't my car. This is my mothers. She is fighting cancer and doesn't deserve this. I'm sick of watching this dealership take advantage of her and others. This is the fourth time in two years that they have done something like this. You may feel that it won't do any good, but I disagree. I'm sick of people who don't stand up for anything, and I'm sick of being one of them. I'm not a hothead or irrational or fuming. I'm just feedup and have a few afternoons free. Nothing more. All I want to know is if it's legal. That's all. Legal advice. Thanks to those who might understand.

A: Be sure you do it in the fast lane for maximum effect. Hint: Save you breath to cool your soup.

Q: How much does a ticket for driving over the train tracks when the train crossing arms are down in Texas?
This happened in Irving, Texas where I live. After the train had passed the arms stayed down for some reason and about 10 cars ahead of me when through them over the tracks anyway. I saw no other way out so I followed them. I was the one who got a ticket for it. I have heard that this is a particularly bad ticket. Does anyone know how much it costs and if I can do defensive driving? I can't find out for 7 days until I can go to the courthouse to deal with the ticket.

A: The city of Irving has the most common citations and fines posted at http://www.ci.irving.tx.us/municipal_court/fines.asp It says, for example, that Violation Number 3204 - Ran red light has a fine of $250. Supposedly, if you go to https://ecs.ci.irving.tx.us/Court/, you can enter your citation number and see what the fine is.

Q: help i am getting ripped off by a car dealership and my credit is ruined?
i bought a car and obviously was ripped off. i am a single mother with little credit and it is being ruined by toyota of irving. i had the car for 4 months. the car was overpriced by 10,000. i signed the note and had full coverage insurance. the car was wrecked and the lienholder was paid but they are putting a chargeoff on my credit for 10,000. the insurance company says the car was priced way too high and i was ripped off help

A: This sounds like a job for the Better Business Bureau. If that doesn't work, lawyer up and threaten to go to court. Then, if need be, file a small lawsuit. You lack of credit doesn't give the dealership a right to jerk you around.

Q: What happens when a police car crashes into you?
Ok an Irving polic car crashed into my car and i was with my one year old niece. We are both ok thank God. So what happens now? Will my car be fixed or what? It was not my fault. It was the cop's fault. I don't need your smartalic or childish remarks.

A: The city's insurance company will send out an adjuster to look at your car's damage, and they will pay to fix the damage. Also, if you had any medical bills or lost work time, they will pay for that too. They will indemnify you. Indemnify means 'make whole', or put things back like they were before the accident. You need to call the city attorney's office (you can find their number in the blue pages in the phone book) and ask them when they'll be taking care of your damage. I'm glad you and your daughter are okay. - Stuart

there were bad weather and tornado warnings on April 13, 2007, the same day that a police officer was killed on 183 due to a car crash. Do any one know what time the sirens went off that day before the rain finally started.

A: This is the only thing I found that shows specific times from that date. It's from the National Weather Service. It doesn't mention anything about sirens, though.
